It also appears that the same disk was used on two servers. Checking the registry key
hklm/software/microsoft/mssqlserver/mssqlserver/currentversion/

serialnumber value is same on both servers.
(I am assuming the license does not extent to installing on separate servers that are not clustered)

So I really am asking this question so that I know what version to buy for the second server so I can make them legal.

That's the simplest way I know of. You can do select @@version, but I sometimes get confused if that displays Windows Enterprise version, or SQL Enterprise version. This spits out only the SQL Server edition type (standard/enterprise).
